Statement by China (9 March 2023)

Legal review is a provision in AP I of Geneva Conventions. All High Contracting Parties to the Geneva Conventions should strictly fulfil the obligations by carrying out legal reviews on AWS and other new weapons. Such reviews can help to prevent misuse of technology and lowering civilian casualties. China, like many other countries, have in place relevant review and assessment mechanisms.

It is a view of my delegation that countries differ widely in terms of development and application of technology. Legal review as a confidence building measure under the current stage should allow all countries to act in accordance with the national circumstances and in line with the provisions of the international law and international humanitarian law by taking further implementation measures, and also within the framework of existing legal and military regulation regimes, including through industry regulations, ethical declarations, and code of conduct, in order to strengthen the guidance and supervision of the development in relevant technology and industry, and to exchange experiences on a voluntary basis.
