Statement by the Russian Federation (28 August 2024)

As we said before, obligations under Article 36 of Additional Protocol I do not provide for an automatic prohibition of one or other kind of weapons as not in line with the requirements of IHL because of the objective impossibility of providing for and taking into account all cases of improper use. We believe that the risk of abuse arising in this connection for any type of weaponry, regardless of the level of its autonomy, can and must be reduced through the application of other procedures, which provide in particular for the personal responsibility of those involved. Furthermore, the article does not contain provisions as to how legal reviews can be carried out and does not place on states an obligation publicly to state their outcomes or provide anybody with information on this. The Russian Federation has an overall state system, which provides that on the basis of the existing legal system, it is possible to carry out control of samples on the basis of the obligations at all stages of work.
