IHL and ERW: Response from Switzerland (3 August 2005) CCW/GGE/XI/WG.1/WP.13

What measures have been taken by your State to implement those existing principles of international humanitarian law that are considered by your State as relevant to the use of munitions, including submunitions, that may become ERW?

In answering this question, States may like to address, among other issues, the following specific questions: …

(v) Does your State have a mechanism to review the legality of new weapons, methods of warfare and military doctrine? (If yes, what is the legal basis for those systems?)

33. Switzerland has implemented a review mechanism within the defence structure. At the beginning of a procurement process, the IHL section of the staff of the chief of the armed forces is consulted by the organization in charge for the procurement project. The IHL-section may formulate specific requirements for tests during the evaluation process; it may also request to stop certain projects.

34. Currently, an inter-departmental working group is assessing possibilities for strengthening the national review procedure based on article 36 of AP I.
