We further place on record our understanding that formulations expressed as must in the current text including but not limited to paragraphs 31, 32, 34, 37, 41, 42 as they stand, are intended to reflect existing obligations and apply to each state only in accordance with and to the extent of that state’s own obligations under applicable international law, including in case of states such as Turkey that are not party to Additional Protocol I to the Geneva Conventions. Accordingly, the legal reviews referred to in paragraph 37 are to be conducted by each State in accordance with its own obligations. We also place on record that our acceptance of these formulations should not be understood as an acknowledgement that they reflect settled rules of customary international law applicable irrespective of a State’s treaty relationships.
