Overview
The Brazilian system for assessing legality of weapons is reflected in Annex I of Decree No 10.030 of 30 September 2019. Article 2 of Annex I indicates capabilities requiring a review. These are defined as ‘products controlled by the Army Command’, that is, products:
- ‘exhibiting destructive power’;
- ‘that may cause harm and damage to persons or property’;
- ‘the use of which should be restricted for reasons of public safety’; or
- ‘of military interest’.
Article 18 of Annex I specifies that ‘compliance with the minimum safety and performance requirements’ of those products will be assessed and certified by the Conformity Assessment Authority, which fulfils the requisite accreditation requirements and has been designated to carry out such assessment and certification tasks by the Army Command. Autonomous systems fall under the review scope.
